Apply for Australian Citizenship under these Pathways

Other pathways to acquire Australian Citizenship applies to individuals under these categories: 

  • Children under 15 years of age who are permanent residents 
  • Individuals born from parents who were former Australian citizens 
  • Children adopted under the Full Hague Adoption Convention bilateral agreement by an Australian citizen
  • Individual born in Papua New Guinea before the 1975 Independence 
  • Previous Australian Citizens 
  • Stateless individuals born in Australia 

All applicants must be of good character and pass the Australian Government’s character requirements, including not having recorded criminal convictions and reported domestic violence. You must also not have provided false or misleading information concerning previous visa or citizenship applications.

Children under 15 years of age who are permanent residents 

Individuals aged 15 years or younger can apply for Australian Citizenship on their own provided the following conditions:

  • living with an Australian Citizen parent/s who consents to the application
  • you are a Permanent Resident of Australia and whose parent/s meet the general residence requirements but has decided not to apply for Australian citizenship because they would lose the citizenship of another country
  • for applicants whose parents are not Australian Citizens, you must prove that by not becoming an Australian Citizen would make you suffer significant hardship or be disadvantaged

All applicants must be of good character and pass the Australian Government’s character requirements, including not having recorded criminal convictions and reported domestic violence. You must also not have provided false or misleading information concerning previous visa or citizenship applications.

Individuals born from parents who were former Australian citizens

Individuals born outside Australia from parents who were former Australian Citizens can apply for Australian Citizenship through this scheme following these conditions:

  • born from parent/s who were previous Australian Citizens before you were born
  • born from parent/s who were previous Australian Citizens who lost their citizenship before the 4th of April 2002
  • parent/s lost their Australian Citizenship by acquiring the citizenship of another country before the 4th of April 2002

All applicants must be of good character and pass the Australian Government’s character requirements, including not having recorded criminal convictions and reported domestic violence. You must also not have provided false or misleading information concerning previous visa or citizenship applications.

Make sure that you have the necessary evidence to show that you are born from parent/s who were previously Australian Citizens.

An Australian Citizenship allows you to:

  • stay in Australia indefinitely
  • work and study in Australia 
  • travel to and from Australia as many times as you want 
  • sponsor dependent children or eligible family members to come to Australia
  • enrol in Medicare, Australia’s public health care scheme 
  • get private health insurance if you have an interim (blue) Medicare card or a full (green) Medicare card

Children adopted under the Full Hague Adoption Convention Bilateral Agreement by an Australian Citizen

Individuals born overseas and adopted outside Australia by an Australian citizen through the Hague Adoption Convention Bilateral Agreement can apply for Australian Citizenship through this pathway if they meet the following qualifications:  

  • have a valid adoption compliance certificate
  • adopted by at least one parent who was an Australian Citizen at the time of your adoption
  • if the parent acquired Australian Citizenship through descent, your adoptive parent/s must have at least lawfully spent 2 years living in Australia when you apply for citizenship
  • if you are 15 years or younger, your adoptive parents must apply on your behalf

All applicants must be of good character and pass the Australian Government’s character requirements, including not having recorded criminal convictions and reported domestic violence. You must also not have provided false or misleading information concerning previous visa or citizenship applications. 

Make sure that you have the necessary documentation to prove that you were adopted by an Australian Citizen under the Hague Adoption Convention Bilateral Agreement.

Individuals born in Papua New Guinea before the 1975 Independence

Individuals born in Papua New Guinea before the 1975 Independence can apply for Australian Citizenship through this pathway if they meet the following qualifications:  

  • have a valid proof of birth (Birth Certificate) 
  • must have been born in Papua before 16 September 1975
  • have at least one parent who was born in Australia and was an Australian citizen at the time of your birth

All applicants must be of good character and pass the Australian Government’s character requirements, including not having recorded criminal convictions and reported domestic violence. You must also not have provided false or misleading information concerning previous visa or citizenship applications.

Previous Australian Citizens

Individuals who were previously Australian Citizens can resume their Australian Citizenship through this pathway if they meet the following qualifications:  

  • is a citizen of another country as an adult before 4 April 2002
  • have solid evidence on why you ceased your Australian Citizenship: mainly to acquire or retain the citizenship of another country
  • have solid evidence on why you ceased your Australian Citizenship: to avoid significant hardship or detriment
  • your Australian citizenship was revoked as a child when your responsible parent’s Australian citizenship ceased
  • you were an Australian citizen by registration or naturalisation but continuously resided outside of Australia and New Guinea for 7 years between 26 January 1948 and 8 October 1958

All applicants must be of good character and pass the Australian Government’s character requirements, including not having recorded criminal convictions and reported domestic violence. You must also not have provided false or misleading information concerning previous visa or citizenship applications. 

Applicants denied of resuming their Australian Citizenship through this scheme may apply for a new Australian Citizenship by Conferral.

Stateless individuals born in Australia

Individuals who meet these qualifications can apply for Australian Citizenship through this scheme:  

  • born in Australia on or after 1 July 2007
  • never have been a citizen of another country/nation
  • is not entitled to acquire the nationality or citizenship of another country

All applicants must be of good character and pass the Australian Government’s character requirements, including not having recorded criminal convictions and reported domestic violence. You must also not have provided false or misleading information concerning previous visa or citizenship applications. 

Parents of applicants aged 15 Years and below must apply on behalf of their children and are required to attend an interview with the Department of Immigration.

There are many possible reasons why your Australian Citizenship application could have been denied. Usually your refusal letter from the Department of Immigration will provide a brief explanation as to why your citizenship application was refused. Our migration agents can help you understand why the Department refused your application and whether you can appeal the decision by undertaking an assessment of your application.

Some common reasons why citizenship applications are denied include: insufficient evidence to support the claims made in the application, changes in government policy or if you have breached any conditions.
